Terms of Service

Welcome to TrueMelodies. These Terms of Service ("Terms") govern your use of truemelodies.com and your purchase of our custom song products. By using the site or placing an order, you agree to these Terms. TrueMelodies is operated by Gabe Marketing LLC, a Delaware limited liability company ("we", "us").

1. What We Provide

TrueMelodies creates original, personalized songs based on the details you provide in our questionnaire. Songs are produced using professional music-production technology, including licensed AI-based composition tools. Every song is created individually from your story and checked before it's sent — no two are alike. You can listen to a preview of your song before deciding to purchase.

2. Your Content

When you submit stories, names, memories, or other material ("Your Content"), you confirm that you have the right to share it and that it doesn't infringe anyone else's rights or contain unlawful material. You grant us a limited license to use Your Content solely to create and deliver your song and provide related support. We will never use Your Content in advertising or share it publicly unless you give us express permission — for example, by sending us a reaction video and telling us we may use it, or by posting publicly with a hashtag we've invited you to use. You can withdraw that permission at any time by emailing support@truemelodies.com. We may decline to produce songs from content that is hateful, harassing, unlawful, or infringing, with a full refund of anything paid.

3. Your Song — Yours to Keep

When you purchase a song, you receive a permanent, personal-use license to your finished song: play it, download it, share it with family and friends, use it at events, post it in personal (non-commercial) contexts. The song is yours to keep — we deliver the audio file directly to you by email so you always have your own copy, independent of our website.

Commercial use (reselling, streaming monetization, advertising use, synchronization) requires our written permission — email us; we're usually happy to arrange it.

4. Your Song's Delivery Page

Each song comes with a personal delivery page (and, with the Keepsake Edition, a designed keepsake reveal). These hosted pages are provided as a courtesy alongside your purchase and we intend to keep them available. If we ever discontinue hosted pages, we will give you at least 60 days' notice by email so you can download anything you haven't already. Your downloaded files are yours permanently regardless.

5. Delivery

Your song is created before you purchase — you hear a preview of the actual song first. When you complete payment, your full song unlocks on your personal song page and we email you your files. We deliver within 24 hours of purchase.

In rare cases — technical issues, provider outages, or unusually high volume — delivery may take up to 24 additional hours. We'll email you if that happens. If we still haven't delivered after that, our Refund Policy applies and you can have your money back in full.

It's your responsibility to provide a correct email address and to check spam or promotions folders; your song page remains available to you regardless, and we're always at support@truemelodies.com.

6. Revisions and Corrections

We want you to love your song. Every order includes free correction of any errors (names, key details) and free revisions within 30 days — adjustments to the song you received, such as lyrics, phrasing, or details. Revisions are not unlimited: if several rounds still haven't got it right, we will offer a full refund instead of continuing to revise. See our Refund Policy for the full promise.

7. Prohibited Uses

You may not use the Services to violate any law, infringe intellectual property, harass or harm others, submit malicious code, scrape or overload our systems, or resell our services without permission.

8. Intellectual Property

The TrueMelodies name, site, design, and technology are our property. Your finished song is licensed to you as described in Section 3. Underlying production elements, templates, and systems remain ours.

9. Disclaimers and Limitation of Liability

The Services are provided "as is." To the fullest extent permitted by law, we disclaim implied warranties and our total liability for any claim relating to the Services is limited to the amount you paid us for the order in question. Nothing in these Terms limits liability that cannot be limited by law, and nothing affects consumer rights that applicable law grants you.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located in Delaware, except where applicable consumer law gives you the right to your local courts.

11. Taste Is Subjective

Every song is created individually from the details you give us, and music is personal. We promise a professionally produced, original song built from your story — we can't promise a particular artistic outcome, a specific voice, or that a song will sound like any particular artist or existing recording. Your preview exists precisely so you can hear the actual song before deciding to buy. Our commitments if something is wrong are set out in our Refund Policy.

12. Accuracy of What You Give Us

We create your song from exactly what you submit. Spelling of names, pronunciation notes, dates, and details are your responsibility — please check them before submitting. Delivery goes to the email address you provide; it's your responsibility to enter it correctly and to check spam or promotions folders. If you spot a mistake, email support@truemelodies.com and we'll correct genuine errors free of charge as described in our Refund Policy.

13. Service Availability and Third-Party Providers

Our service depends on third-party providers (payment processing, hosting, email delivery, and music-production technology). We aren't liable for delays, interruptions, or failures caused by events outside our reasonable control, including provider outages, network failures, or force majeure events. If we can't deliver your song at all, you receive a full refund — that is our sole obligation in these circumstances.

14. Orders We May Decline

We may refuse or cancel any order at our discretion, including where the request is unlawful, abusive, infringing, or would require content we're not willing to produce, where payment cannot be verified, or where we reasonably suspect fraud. If we decline an order, we refund it in full.

15. Payment Disputes and Account Abuse

If a charge looks wrong, contact support@truemelodies.com first — we resolve nearly everything within hours. Initiating a chargeback without contacting us delays resolution, and we reserve the right to respond to disputes with our delivery records (including preview access, purchase, and delivery timestamps). We may decline future orders from anyone who files fraudulent or abusive disputes.

16. Indemnification

You agree to indemnify and hold harmless Gabe Marketing LLC, its owner and its providers from any claim, loss, or expense arising from content you submit to us, from your use of a song outside the personal-use license in Section 3, or from your breach of these Terms.

17. Electronic Communications

By placing an order, you consent to receive order-related communications from us electronically (email and, where you provide a number, SMS). These are service messages necessary to deliver your purchase. Marketing messages are separate and always carry an unsubscribe option.

18. Age Requirement

You must be at least 18 years old, or the age of majority where you live, to place an order.

19. Intellectual Property Complaints

If you believe content on our site infringes your rights, email support@truemelodies.com with a description of the work, the location of the material, and your contact information. We investigate and remove infringing material promptly.

20. Assignment, Severability, Entire Agreement

We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them. If any provision is found unenforceable, the rest remains in force. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between us regarding the Services, and supersede any prior statements or advertising.

21. Changes

We may update these Terms from time to time; the current version always lives at this page. Material changes apply to orders placed after the change.
